Syria Asylum Applications: Karlsruhe Administrative Court Orders Bamf to End Delays
After six months since the fall of Syrian dictator Bashar al-Assad, the Administrative Court in Karlsruhe has ruled that the Federal Office for Migration and Refugees (Bamf) no longer has grounds for delaying decisions on asylum applications from Syrians in Germany.
In a decision dated May 23rd, the court granted the complaint of a Syrian asylum seeker, who had been waiting for a decision on his application. The Bamf is now compelled to process this individual's case promptly.
While the court's verdict does not specify the content of the decision Bamf is required to make, it will first need to hear from the complainant. The court's ruling only pertains to the question of Bamf's entitlement to further postpone a conclusion on the asylum application, previously citing an unclear situation in Syria as a justification. According to the Administrative Court, the latest developments in the country provide sufficient information for a decision to be made.
Syria's new government, led by the Islamist HTS militia, has been in power since December 2024. The regime has controlled most of the country since this time, and the Bamf, EU asylum agency, and German courts have all issued compelling reports and assessments regarding the asylum and deportation situation after the power shift in the country.
With these factors considered, the Administrative Court stressed that there is no longer a reason to defer decisions on Syrian asylum applications. However, the Bamf can still appeal the ruling. The office can no longer rely on the Asylum Act provisions that allow for a temporary suspension of processing applications in cases where the situation in the country of origin is unstable.
Since late 2024, Bamf has temporarily stopped making decisions on Syrian asylum applications due to the uncertain security and political situation in Syria. While hearings resumed in early May, formal decisions are still on hold, with cases remaining under review. A reevaluation is expected by early June, but until then, no formal approvals or rejections will be issued for Syrian asylum claims.
In conclusion, the Bamf is now obligated to proceed with hearings for Syrian asylum seekers but must hold off on making definitive decisions until further review, reflecting the ongoing cautious approach evident in both administrative practices and recent court rulings.
- The community institution in Karlsruhe, the Administrative Court, has ordered the German institution for migration and refugees, Bamf, to cease delays in decisions regarding asylum applications from Syrians.
- Science and health-and-wellness professionals, following the political developments in Syria, have provided comprehensive reports and assessments about the asylum and deportation situation in the country.
- In light of these reports and the right of establishment for Syrian refugees, the court ruling emphasizes the need to expedite decisions, which includes the right of family reunification for those granted asylum.
- War-and-conflicts, crime-and-justice, and general-news outlets have been closely monitoring the migration of Syrians, with continued attention necessary as Bamf reevaluates its asylum policies in the face of changing circumstances in Syria.
