Federal Democratic entities file lawsuits against the Trump administration over the termination of sex reassignment surgeries for teenagers

The provision of gender-affirming care for minors in U.S. hospitals is currently facing a significant disruption, with many hospitals suspending such services due to federal policy actions and state bans.

The lawsuit, filed in the U.S. District Court for the District of Massachusetts, names President Donald Trump, Attorney General Pam Bondi, the Justice Department, and several states' attorneys general as defendants. New York Attorney General Letitia James is leading the coalition of states in the suit.

The lawsuit argues that the administration is effectively trying to impose a nationwide ban on sex change procedures by threatening providers with "baseless criminal charges" and investigations. The Justice Department is indeed investigating several children's hospitals for providing gender transition treatments, and the Trump administration's Jan. 28 executive order bars government support for sex change operations and treatments.

In response, more than a dozen states have filed lawsuits to protect gender-affirming care from federal interference and investigations. The states contend that the federal actions unlawfully restrict access to medically accepted care for transgender youth.

The impact of these investigations and enforcement threats has been described as chilling lawful care. Providers are shutting down programs even in jurisdictions where such care is legal, which has prompted legal pushback by states.

Since around 2021, more than half of U.S. states have banned gender-affirming care for minors, significantly limiting access based on state law. Concurrently, federal agencies have increased pressure on providers: the Department of Justice (DOJ) and Health and Human Services (HHS) have issued subpoenas to hospitals and doctors who provide gender-affirming care to minors, threatened funding cuts including Medicaid payments, and emphasized legal enforcement actions framed as protecting children from “harmful interventions.”

This trend is not limited to the U.S. The United Kingdom has banned puberty blockers for children seeking treatment for gender dysphoria, and the Trump administration's memo directs the Justice Department to investigate and prosecute those who offer sex change treatments to minors.

The White House spokesperson, Taylor Rogers, supports the Trump administration's efforts to protect children from gender transition treatments. However, the ongoing litigation and widespread access challenges for transgender youth persist.
