"My daughter was taken by a monster," sobs Eleonore Nagy, brimming with tears. She feels a sense of shock that the authorities seem to be sweeping this tragedy under the rug. Her outcry? "We need justice."

In 2022, her 40-year-old daughter Kamilla perished in a psychiatric hospital near Munich. A man, previously known to police for announcing that he had to kill someone, murdered her in her hospital room.

"The circumstances surrounding this horrendous act and why Kamilla had to meet her end remain a mystery to this day," says Jella von Wiarda, the lawyer for the Nagy family. They implore for a thorough, lawful investigation and thus filed a petition for compulsory prosecution at the Munich Higher Regional Court.

A spokesperson for the judiciary confirmed the receipt of the application, and the case files have been sent to the Public Prosecutor General's Office. The timeline for a decision remains uncertain.

The man who killed his hospital companion at the Isar-Amper Clinic later admitted in court that he had tortured her with a metal rod, choked her with her sweater, and then set her aflame. His attorney stated that God had ordered the act because the woman was a witch.

"Kamilla wasn't struck down by a speeding vehicle on the street," asserts her mother. She was "slaughtered in a sanctuary," a place where she sought refuge.

The man had been admitted to the clinic just hours prior, due to his declaration that he had killed a dog upon God's command and intended to kill a human. According to von Wiarda, the man had plunged a pair of nail scissors into the arm pit of his dog and ultimately strangled it.

Scarcely hours later, he allegedly ripped off the shower rod from his bathroom and stormed into the lavatory belonging to the patient. As per the application, he strike her head with it approximately two dozen times before choking her with her sweater and igniting the fire.

Why was no one there to intervene?

"This man was able to navigate freely on a closed psychiatric ward," reports lawyer von Wiarda. Unnoticed, he could have torn off the rod. "He strolled through the ward corridors undetected with it." It wasn't until the fire alarm was activated that the staff reacted.

Court records suggest that the ordeal may have lasted for up to an hour. "The duration of this brutal assault is still a question that lingers today," says von Wiarda, reminiscing about the "grotesque execution."

Why were no staff members or fellow patients able to prevent the attack? Why was no one there to intervene? These questions continue to baffle the Nagy family - and at times, even Munich I Public Prosecutor's Office.

In 2022, the authority initiated an investigation against unspecified individuals to clarify "whether a criminally relevant omission by the treating doctors or nursing staff, in connection with the death of the victim, can be established, which facilitated the act of the now convicted offender," clarified a spokesperson for the office. The accusation: negligent homicide via omission.

The public prosecutor's office commissioned expert opinions, heard witnesses - and terminated the proceedings in January of the following year. The reasoning? No criminally relevant behavior could be established beyond a reasonable doubt. The General Prosecutor's Office in Munich declined to consider a complaint regarding the discontinuation. The unfavorable decision was received on March 24.

The Isar-Amper Clinic declined to comment on the incident - nor would they offer insights on whether safety measures have been updated since then.

Not only did Kamilla become a casualty of psychiatric treatment - but the man who murdered her allegedly remained unexamined upon his admission. He entered the facility as a mentally ill person, and exited it as a criminal. Perhaps elsewhere, another mother mourns the loss of her child. "I'll never again see her smile," muses Eleonore Nagy about her daughter.
