German Court to Rule on Landmark Climate Lawsuit Against Energy Giant RWE
A resolution is imminent in the years-long legal battle between a Peruvian farmer and energy corporation RWE, as the Higher Regional Court of Hamm prepares to announce its decision today. The lawsuit, initiated in 2015, centers on Saúl Luciano Lliuya, a farmer and mountain guide who seeks financial reparation from RWE for part of the cost associated with safeguarding his home in Huaraz from potential flood risks arising from the Palcacocha glacial lake.
Lliuya claims that RWE shares fault for this impending danger due to their significant greenhouse gas emissions. Lliuya's case is backed by the Future Ability Foundation and environmental organization Germanwatch. RWE contest the lawsuit's admissibility in court.
Expert testimony fortunately does not foresee a substantial threat to Lliuya's dwelling within the next thirty years, citing a one percent probability of realistic flooding scenarios. Lliuya's legal team disputes this assessment, alleging that the experts have undervalued the associated risk.
A bias complaint filed by Lliuya against one of the expert witnesses was dismissed. Consequently, the court postponed the initially scheduled decision date from April 14 to May 28.
